Section 166 Remediation – Getting Things Fixed

The skilled person or independent report reviews remain a key tool in the regulators’ armoury to drive transformation and change through remediation. A total of 51 section 166 ‘skilled person’ notices were issued by the Financial Conduct Authority (FCA) and Prudential Regulation Authority (PRA) in the year to March 2019. Interestingly, the regulators’ concerns are mostly around financial crime, business conduct and controls, and risk management frameworks. These reviews are not only intrusive and disruptive; they also have wide-ranging implications requiring management’s full attention to address. Essential to this is having a remediation team skilled and equipped to effect the necessary changes. Better still is to get ahead of the curve and seek advice and assurance on areas of concern or suspected weaknesses in the firm’s controls and compliance frameworks.
